IRS Tax Audits & IRS Tax Appeals

IRS TAX AUDITS

When most people receive that letter in the mail that states that they are getting audited by the Internal Revenue Service, they get upset and nervous to their stomach.  No one ever wants to go through an audit, let alone a tax audit.

If you have filed or believe that you have filed your tax returns correctly, then you have nothing to worry about.

Just because you get selected for an IRS audit does not mean that you have done anything wrong.  An audit by the Internal Revenue Service is nothing more than an examination of a taxpayer’s tax returns to determine if reported information is correct.

If you receive notification that you are being audited, then you should also know that there is a Taxpayer’s Bill of Rights which protects you against unfair treatment by Internal Revenue Service auditors.

The best actions to take when first confronted by an IRS auditor is to inform the auditor that you need to seek legal counsel before going any further in answering any of his or her questions or providing any documentation to him or her.  Do not share any information with the auditor because no matter how nice the auditor may be, he or she is there to do their job.  And that job involves finding inaccuracies in your information.

Please do not make the common mistake and talk to the IRS first and then come see a Tax Lawyer.  Also, you can request any meeting with the IRS to be at a neutral location.  Auditors like to make unannounced drop-by meetings at your place of business or personal residence.  You are fully with in your right to ask that the meeting be rescheduled to another place and time.  Just remember, the IRS auditor is doing his or her job, and you must take every precaution to protect yourself.

If you are being audited by the Internal Revenue Service and you want to protect your rights and be treated fairly, call Tax Lawyer Kenneth L. Sheppard, Jr. at 1-877-505-9455 for your free consultation.

IRS TAX APPEALS

The IRS Tax Appeal process is typically the last, and sometimes the best option, a taxpayer may have to resolve his or her tax problem.  During an audit, or other collection process, the IRS is attempting to get their hands on as much of your income and assets as they possibly may.  However, this is definitely not the case in the appeals process.  During an IRS Appeal, the Internal Revenue Service is seeking to settle the matter.

In order to start the IRS appeals process, you need an experienced Tax Attorney to submit a formal protest letter and request the IRS auditor’s file.  The protest letter will state that you disagree with the IRS determination, and provide reasons supporting your position.  The IRS auditor’s file will provide you with valuable information, as you proceed through appeals process.

Tax Attorney Kenneth Sheppard has assisted both individual, and business taxpayers, challenge IRS determinations.  Although the appeals process may take several months to complete, taxpayers may generally achieve significant savings on their tax bill.

An IRS Appeals Officers’ goal is to end the IRS controversy.  They are more willing to consider a taxpayer’s position, than any other employee of the IRS.  Furthermore, they are not handling the case to see how much of your money they can get their hands on.

During the hearing, which will be held at the IRS Appeals Officer’s office, we will present your case on your behalf.  Tax Attorney Kenneth Sheppard employs a reasonably aggressive approach, when representing his clients in front of the IRS.  Our clients’ goals are usually to resolve the IRS controversy, and do so, in an expeditious manner.

We will negotiate a settlement for you at that appeals hearing. If a settlement is reached, then the IRS Appeals Officer will issue a Form 870, Consent to Proposed Tax Adjustment.  By signing this formal document, you agree to pay the amount of the settlement, and you can no longer challenge the existing tax issue and/or tax case.

If you have received documentation from the IRS informing you of your rights detailing the IRS Appeals process, you should act quickly, and obtain legal and tax representation.
